The “equal footing” principle
The United States Supreme Court’s 2015 Obergefell decision that families of same-sex couples are due equal treatment to those of opposite-sex couples has led to other important precedent regarding the rights of LGBTQ+ individuals including regarding parentage presumptions and parental rights generally, but Alabama’s legislature and courts have unfortunately remained hesitant to accept and/or recognize those in some instances. Gregory Fann Turner recognizes that this means that litigants are due equal treatment in our courts regardless of gender, gender identity, or sexual orientation, such that husbands and wives, mothers and fathers, children, and members of the LGBTQ+ community and their families are all due the same dignity and fair treatment. The same principles properly apply to age, race, religion, socioeconomic status, and disability. Advocacy for those principles is essential to protection of not only clients’ individual rights, but those of the community at large.
